Hi,
I would like to apply for the H1B Visa. For the same, I would like to clarify whether I am eligible with the following education background (Basically I am looking for the 16Yrs education criteria)
1) Did schooling up to 10th (10 Yrs)
2) Did Diploma (3 Yrs, Full Time)
3) Total IT work experience is 9.10 Yrs
4) Did B.S ( Bachelor of Science -- 3Yrs - Work Integrated Course/Distance Edu)
5) Did M.S (Master of Science -- 2Yrs - Work Integrated Course/Distance Edu)
Please let me know whether I am eligible.

Not surprising, but surprising that Luis would admit it. And if this is the case (and I think it is), then the question is whether we wait until 2011 or later to push again or finally decide it's time to look at other strategies like piecemeal reform (pass DREAM, AgJobs, legal immigration reform now and deal with legalization later) or look at administrative actions like TPS or parole and a moratorium on deportations for people who would otherwise meet the requirements of a proposed legalization program.

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?

I have filed two different I-140s for EB2-NIW (NSC, Nov 06)) and EB1-EA (TSC, march07). Both are pending at the moment. I wish to apply for I-485 now as the visa numbers are current in both categories.
I will appreciate if some one could advise if I can go ahead with the filing with pending I-140s. Also in that case can I file a single I-485 now and just ask it to be linked to whichever I-140 is approved first. will this work?
In this case whcih 140 number should I mention in my application and whcih center should I send the application to?

It has to be 693 as per my understanding. The doctors usually have their versions of 693, in multipart (3-4). I think the 4th part is green and is intended to be your copy. Along with 693 there is a supplement page for vaccinations etc.

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

Hello everyone,
This question is for my wife. She is currently in her 5th year of H1 which expires in Oct-2011. i.e Her 5th year ends on Oct-2010. She is planning to quit her job now (Aug-2010) due to personal reasons and plans to switch to H4. Her employer (Company-A) has already filed for her GC and her LCA and I-140 is approved, but I believe they will be discontinued once she quits. So here are my questions -
1. Since she will have a little bit over 1 year remaining on her H1, can she file for H1 again if she get a new job offer?
2. Assuming that her next company (Company B), files for a GC within one year, Will there be a problem getting her H1B extended ? Since her new LCA (with Company-B) will be filed less than 365 days before her H1b expires.
3. OR Will USCIS look for the LCA filed by Company-A and grant her H1B extension?

My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?
Nope...she has to start with Labor and apply for a 140 in either EB3 or EB2 categories. Only L-1A visa holders are eligible to skip labor and apply in the EB1 category.

I need some advise on my situation.
I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.
So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?
Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.
Please give me some advise.
