My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.
In the mean while I am thinking about switch the employer.
I am in 8 th year extension and My VIsa is valid until jan 2008.
1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.
2.What are the pros and cons I should think about when I switch the company.?

I have few questions and seeking your advise on it. Currently I have a H1B and EAD with EB3 category GC application.
1. I am working on H1B for "X" company and they have filed extension for it. Now, I got an offer from "Y" company and they are willing to transfer my H1B.
Is there any problem for H1B transfer to the Y company while it is filed for extension from my current employer?
2. The new company "Y" is also going to file my new GC labor and I-140 as job has little different and senior role but similar to what I had in my previous H1B and GC labor in EB2 category.
Now, can my current employer "X" company remove I-140 or create any kind of problem for my immigration status, specially with GC?
Any information, you can provide will be really helpful.

Your PD must be current and 485 filing date (which is also called RD - received date) should be close to USCIS processing times. Currently, I believe that USCIS is working on applications that it received in July 2007.
But it is USCIS :D - miracles happen!!! Last year, they approved 2006 PD cases while applicants with 2003/2004/2005 were waiting :D Good luck.

Now, I got 2 offers. First one is a fulltime position and 2nd one is a contract with a primary vendor (directly working on W2 using EAD). I haven't decided which one to join.
What are the options, I have? Do I need to file AC21? Since my file is already processed and waiting for the PD to become current, am I OK, even if I don�t apply for AC21? If I file AC21 and if the job descriptions are not matching or because of any other issues, if there is an RFE, I will be having some issues.

I filed my 485 in August 2008 with new fee structure (one time fee for AP and EAD renewals). Now my AP is expiring in November 2009. Can any one who applied for AP renewal under the one time fee structure let me know how do I make use of that fee. I mean.. Can i just skip sending the check for $305?

I recently received a RFE on my I-140 application for special registration (only apply for men born in the middle east). My attorney and I replied to the RFE letter explaining why I did not register for the requirement. It is been three months since they received my letter (as shown on the e-gov website). I still have not heard anything from USCIS. My status still reads 'RFE: Response Review'
My question is :
Do they always formally reply back to the applicant's RFE response and indicates whether they accepted it or not.? If so, will it be within the 4 month process time.?
Aprreciate any thoughts.

I am in a weird situation here, I was Laid off on July 21st with pay in lieu until 4th August. I had applied for Change of Status to F2 (my wife is on F1) on 17th August. On 31st August I got a job offer and applied for H1B transfer to USCIS on 8th September (using 15th august paystub as the latest).
At the same time i filed to USCIS to revoke my F2 application.
Today I got a notice from USCIS that my application for change of status to F2 is approved as of 09/21/2009.
Now, I dont know what to do, does it mean I am now on F2? Is my H1B transfer application still valid or I need to apply again this time on premium processing.
What should be my next course of action. Any help in this regard would be highly appreciated.

My employer has agreed to do my green card, but are little hesitant to pay the cost (due to budget constraint). What legal options/adjustments can I make with my employer so that the cost process is not delayed? Can they deduct part of my salary to bear the cost etc...?

I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).
From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).
So, the question is whether it is possible to get a new H1 after 6 years on H1?
