My EAD expired in June 2007? I want to get EAD now. Bymistake I discarded my expired ead which is needed for renewal? Should I apply for its renewal or a new one?

I have applied for AP (I131) on 8/14/09 and my I-485 got approved on 9/01/09. Is USCIS is going to return my I131 fee or is there anything I have to initiate from my end to get the refund?.

Hello,
I 'm on H1-B visa already max out and got the extension for 7 th year based on perm pending.
Petition is going to expire in Sep 2011 and last week my perm got denied.
My employer is going to appeal for the perm and also going to apply H1B extension.
Also I got an offer from other employer waited long time for this exiting offer. Not sure what are my options now , is it possible to take the new opportunity or should I stick with my current employer to deal with this issue?
Looking for suggestions ASAP , thanks

Are you legally authorized to work in the country in which you are applying?
what should i specify yes or no? Can somebody explain? Please it is urgent?

Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

Hi,
I have an interview scheduled for my H1B revalidation stamping at the Mumbai consulate next week. My son will be accompanying me for his H4 stamping.
My wife is already in the US(she travelled using her AP).
The FAQ page of the Chennai consulate says that incase both parents are not accompanying the child for the interview, then the absent parent must submit a signed and notarized 'no objection certificate' to the parent going for the interview. There is no such mention on the Mumbai consulate FAQ page.
Question - Does this apply in my case - since my wife is already in the US ?

Who is the best immigration attorney out there to deal with a cross-chargeability case? (Need to claim cross-chargeability based on Spouse's citizenship on an already filed I-485 case).
Any first hand experiences with attorneys like Rajeev Khanna, Murthy, Ron Gotcher etc?? Or is there anyone better (in terms of paying proper attention while filing & being reachable in case of any RFEs etc.,) out there?

Hello all
I have a question. My wife called TSC today, and she talked to one of the most rudest person in the world. unfortunatelly she forgot to write his information down.
Baiscally, while she was talking my son was bothering her and cryin in a low pitch. The bastard TSC agen had the odesity to tell my wife to take the kid away, and htat is he dying.. you should got help him. Obviouslly he was not saying that because he was nice. He started to laguh. I am so furious right now.
So my question is can we find out who this agent was by callin INS and asking them who opened her file last. I sure would love to have few minutes with him one on one. Show him what we do to peace of crap like him if we was back home.
Anyhows, appreciate your answers.

Hello all. This is a basic question: Are all 501(c) employers exempt from the H1 cap? I have heard and read so much about some non-profits being exempt from the H1 cap, but no one could tell me with certainty which ones.

You EAD or AP may be approved at anytime while your 485 is pending, it is a derivative benefit of the pending 485 petition. If the 140 is rejected then everything collapses like a stack of dominos.

By the ways, there is also a possibility to request retaining old priority date, without filing a second 485.
I assume this is just a request letter from attorney or any representative, if they didn't act on it follow-up with a Service Request.

i am waiting for my priority date to become current to file for I-485. But it looks it'll take forever, as evident from May 09 visa bulletin, in which the visa dates are unavailable for EB3 India category. Do you know why dates are retrogressing or stagnant in bulletins after bulletins.
I have another question. My birth certificate is in an Indian language which was issued from the panchayat office where I was born. I want to know if that can be translated to English right here in US for I-485 application. Can somebody else who is not related to me write the translation in English and then get it notarized? If this is the case, then I don't have to go to India or get it done from there from the panchayat office, because this may take a long time. If anyone had tackled issues such as this, please share.

I am F-1 Student at a community college. At the same time, I am teaching at the college that I go to, since I have a Master's Degree....as I am allowed to work on campus 20 hours. The school is not willing to file H1b for me. But if there is another short cut....they might help me with that. Is there any way of receiving Green Card without going through the H1b?

I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.
I did not get stamped yet as i never leave US until now.
Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .
When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
I am going to my country on August 2nd week for my marriage and my questions are.
can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?
can i use the notice as the proof of I129 in case they need it for stamping?
Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

I dont know if people would be interested in discussing the implications of all EB categories turning current. Some of the points to discuss would be:
1) Processing times for I-485
2) Effects on future GC applications.

3) Whats if the CIR is passed in its current form ? How does that affect these categories is at all

Mr. Obama might want to consider transferring the authority of setting quotas from Congress to the Labor Department
May be good or bad, depending on how you look at it....we will then be at the mercy of PERM...
If the Labor Department determines that a foreign worker would not displace Americans, that worker should not be barred from entering the country due to an arbitrary quota
This should definitely be high on the agenda.....although its very doubtful if this can ever be implemented.
