I had infopass appointment yesterday at Dallas. I am waiting for my FP (Check my signature). It was rather simple. They checked the id and the appointment at the outside window and issued a token for me and my spouse (I went alone but took appointment for 2). By the time I cleared security and went inside I already had my token number announced. The IO asked me the reason I was visiting and she checked the 485 notice, punched in something in her system and said you should receive your FP notice within 30 days. She did same for my spouse. I was in and out of the building in 10 mins.

A new report from the Economic Policy Institute makes the case that immigrants at all wage levels actually lift wages for US workers:A key result from this work is that the estimated effect of immigration from 1994 to 2007 was to raise the wages of U.S.-born workers, relative to foreign-born workers, by 0.4% (or $3.68 per week), and to lower the wages of foreign-born workers, relative to U.S.-born workers, by 4.6% (or $33.11 per week). Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. During the first week of April, the USCIS received almost enough H-1B petitions to fill the 20,000 cap for persons with advanced degrees, but only 43,000 petitions against the 65,000 general cap. Over four months later, only 2,000 more H-1B petitions had been approved. Why so few? It's the economy, stupid! But...

My wife came to USA on H4 visa in January 2004. Later when she got a job, she changed that to H1B in September 2004. Since we do not yet have the EAD or green card, her company is now filing the Perm labor certifcation, to make sure that she gets the 7th year extension of H1B. The rule is that you should file the labor before the 6th year starts.
My question is when does her 5th year ends. Was it on January 2009 based on her arrival in USA or is it on Sepetember 2009 sincw her H1B visa started only on Septemeber 2004?

While filing I-485 do I have to choose which I-140 and PD to be used. Need your advise which one should I use,
1. I-140 approved with details as: PERM LC (EB3, PD Dec 2006).
2. I-140 pending (just filed) with details regular LC (EB3, PD Nov 2004).
Choices are:
A. Just file 485 with 140 with earlier PD(option2 ), and let both 140 and 485 continue.
B. File 485 with approved 140
C. Convert pending 140 into premium, and file 485. Is the extra $1000 justified for this?

My wife is on F1 and has applied for AP.
We have been waiting forever for AP(nothing new, right?).
Since her F1 is invalidated for the purpose of re-entry, can she apply for H4? and use that for re-entry?
If you have done this change to H4 recently, I will very much appreciate your reply.

Hi,
I got my H1b approved this year. My first name is set to FNU and my full name was added in last name. Now i have got it corrected in my passport as it was wrong in the first place. After my passport was corrected, I was advised to apply for H1B amendment. I have applied for H1B amendment in November. Also I was unable to get my SSN bcos of this name issue and SSN office is demanding to get I797 corrected before issuing the SSN. Now since I am waiting for my SSN and H1B amanedment. I am not paid. I want to know if I am still legal and I am in status? Please let me know the process I should follow if there are any?
This is extremely urgent and any help/advice in thsi regard wil lbe great.

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

Will it be ok to change employers multiple times on EAD with in shrt span of time difference?
yes, after being a 'chicken' for so long, I changed job on AC21 six months back. And since then changed twice after that. (once forced due to economy, second time moved to a better position) in fact now I am loving the freedom that comes with EAD. Only make sure you stick to same profession (programming) other things like salary or job title etc doesn't matter. Good Luck!
