hello! i overstayed my visa by several years, left , and was able to get a new tourist visa and enter the u.s.
after leaving the u.s, on return,i was denied enterance, removed and banned for 5 years. my boyfriend lives in u.s, he's a citizen. is a fiance visa helpful to allow me in until we get married? is there even a chance? or do we need to marry outside of the u.s in this case? thank you!

Since you were working all these times, please carry the W2 for 2008 ( for both of you). They may/may not ask for this, but its safe to carry the document
I am currently on H1 but planning to go on H4 due to current economic scenario.
I am planning to go to India due to some family reason and planning to get COS from H1 to H4 in India.
I have my salary slips and my husband has also maintained his status throughout.
Has anyone heard any horror stories about H4 stamping cases getting denied.
What documents they ask for when you go for COS from H1 to H4. Besides salary slips can they ask for my W-2's or they need my husband's W-2's only

Can i cancel appoinment one day before.
I saw in www.vfs-usa.co.in website ,have to cancel before two working days of appointment day.
If i cancel appointmentafter few days will i have to fill again DS156,157 forms for appointment.
In website they said cant cancel appointment 2 times.After 2 times cancelation have to wait 90 days with that hdfc barcode.
Before 90 days period can we fix new appoinment by paying agian into HDFC bank.Is this possible new appointment with new barcode.

If it was filed in the EB2 category, it is likely that they picked the case for a random audit. EB2 labors do get audited during PERM processing to ensure that the case does meet eligibility requirements for EB2. There is no clear pattern to this auditing though, some cases get audited and some do not.

Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.

The questions is, if i have an approved I-140 from Company A and I switch over to Company B, then would i be able to file my 485 based on 140 related to Company A when my PD for Labor (company A) becomes current.

Hi all,
I am in a confusing situation would really appreciate some suggestions.
I am the primary applicant and my spouse is the beneficiary for the 485 applications that were sent on July 07. I have received a RFE on my 140. My PD is 12/2004 EB3-India.
My spouse company may be willing to apply for her under EB1C. I have a few questions:
1. Can she apply for 140/485 simultaneously? (I heard concurrent applications are not possible)
2. Can the existing 485s be jeopardized by the new 485s?
3. Do we need to go in for FP and do our Medicals again if we apply for 485s again or are they going to reuse what we have already sent?
4. Do we need to withdraw the existing 485s at some point of time
5. Is this worth the hassel of complicating the applications?
