Hello Attorney,
I filed AP for me and my Dependent , Unfortunately USCIS just picked the application on the top of packet ( My Application ) and i got the receipt No , I dont know what happened to my Spouces Application her check is not cashed and no receipt no , I suppose her applicaiton is was just placed with my applicaiton and was considered as just one application .
Now what are my options , can i go ahead and file one more application , i know its literally impossible for me to call uscis and Track my wife's application , can i go and file a new application for my Spouse . Please advice.

Hi,
I am here in US working for a company on L1 Visa. My Visa and I-94 expires on November 2010. The company has already applied for my H1. I am planning for a vacation to India in August. I have the following question,
1. When I comes back to US from my vacation, in September, I dont have to go to the consulate, as my L1 is still valid. And I wont be able to go to the consulate for H1 stamping, as they wouldnt have started the stamping for this year, right?
2. Once I am back in L1, do I have to go back to India for H1 stamping, as my L1 expires in November?
3. Or the best method is to visit India after October and get it stamped with H1 from the consulate while coming back from India?

Hi All,
We [Me(applicant) and my Wife(H4)] finally received our EAD's last week from NSC :> I have 2 questions:
1. Can i work part time.....apart from my 8 to 5 job based on my EAD. If yes, does the part time job need to be related or similar to my 8 to 5 job?
2. We had our FP done before we got our EAD's. Do we have to go back for additional FP after receiving EAD's? Anybody with similar situation?
Appreciate everyone's time.

I have an issue with my recent H1B approval on Feb'2010. I am seeking your advice in this regard.
I have been in H1B since 11/01/2005 , entered US on 04/20/2006 and my PERM has been already approved with a PD of 03/15/2009. My current I 94 is expiring on 4/13/2010. Recently I got an H1B extension approval of just 1 year (4/13/2010 to 4/13/2011) , which is less than actual 6 years with approved PERM.
Do you think that any appeal or ammendent can be done to extend the approval period? With my H1B petition I had to enclose a client engagement letter which confirmed my engagement but didn�t have any engagement end date there.
If you think that any appeal or ammendent can be done with USCIS, then kindly advise me accordingly. Thanks

I think MVVM is good for the type of apps people are building right now. The way I see it, patterns usually evolve as the type of applications they help build evolve. Many applications even today do not strictly follow a view/model separation even today :P

I am working for my current company since 2001 and started GC process in 2003(EB3 10/2003). So far my company paid all expenses towards my GC. I applied for 485 in 8/07.
Recently I got an offer as Manager. This is a much better position.
If I take that offer, will my current employer have the right to cancel I-140(since he incurred all the expenses towards my GC).
My company's current lawyer will definitely send the cancellation of G-28. in addition I am sure he will also intimate that I am not working with my current employer anymore. In addition I am also afraid he might cancel my I-140 with the intimation from my current employer. In this case, is it better for me to approach a new lawyer and send the AC21 letter attaching my new offer before my current lawyer/employer does their process.
Do i need any other letter from my new employer other than the Offer Letter to send the AC21 letter?
I did not tell my new employer that I am now on EAD (becoz he does not understand anything except GC or Citizenship). is it OK if I dont tell beofre I join them?

Now that name check does not matter because of new rule > 180 days and my PD becomes current from today - April 1 , how long does USCIS take to make a decision about my case ? Do I need to call them and request a case review or do something to see some movement ? Kindly advice. Or is it just wait ?

I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage
We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.
This is my 5th my EAD Renewal and earlier I do not have any issues with Renewals . My current EAD Expires in December 1 Week . Please advise what I need to in this case , as I do not have any clue about pending litigation. Can I check with Local office about what was the pending litigation or do I need to approach through lawyer

Hi all,
I am a consultant working on H1B and my 3rd yr of visa expires in march 2011.
Im planning to file my GC through my current employer in EB2 category(As I have a masters degree) but have following queries :
1.My company is a small company with only 2 employees i.e. me and my manager.
If i do file my GC through such a company,whats are the pros and cons e.g. any RFE expected because its a small company considering that have already had an RFE when transferring my H1B to this company earlier.
2.Can I file my GC through a different employer say my end client or any other company while im working with my current employer?
3.Considering the above situations,what is the best option for me to file my GC at tis point of time?
Also filing my GC in EB2 category will help avid processing delays as per the current trend?
Please advise.

yes, was and thought about it. Just woke up to see Life without GC is still the same and I am a day old. Now, I feel relaxed. Now, there is no need to check or wait for bulletin for the next one year or to atleast have any hope.

As expected this happened, but it happened sooner than expected.
This expected sooner because CIR was voted out in Senate and this was not thought about by this goverment.
Basically this was a close door arrangement between govt agencies which temporarily wanted to lower the friction by IV AND SIMILAR GROUPS.
BUT finally I believe this will come to a rest once we have new government next year.
Till that we are a tennis ball which can be tossed to any court.
PS: I dont even have I-140 and not even applied for one.
So best of luck to all and me.

I have visa stamp in the name of previous employer and I 797 from current employer. I have traveled with these and had no problems at re-entry.
But previous employer has completed processing of my H1B cancellation. Can I still re-enter with visa stamp in the name of previous employer?
