Hi!. I am helping my brother for his PERM. He has a BS Electrical Engineering in the Philippines. Is there a requirement to get an education equivalency assessment for PERM? Does he need to have a US Electrical Engineering license as a support for PERM as well?
He has not yet started yet. We are still studying several options. He also has 7 years experience in the Philippines. Can that BS +7 years outside the US count for EB2 PERM?

Contact Shirley Wu at Rubin Kaplan. She is the one who helped me with my gc process although company paid for it but she is good.....I dont know about $ but atleast you know she is good and just do a google search and you can call them.

I filed in EB2 catagory through company A ( small size company )based on future employment
PD- Sep/04.
I-140- Pending.
I am currently working with company B ( Multinational ). My current status is 5th yr H1B ending in Oct 07..Current employer ( Company B ) has finally approved to file PERM labor..
I am struggling to decide if I should file I-485 with company A awail the current dates and at the same time continue to file PERM in next couple of months with company B..
Would it creat any legel wrangling later on?
I am already in my 5 th yr of h1B with company B and there is no guaranteed job opportunity with company A..
Appreciate if any one in the forum could help resolve my situation.

the format of employment date should be "mm/dd/yyyy", or just 'mm/yyyy'?
my last day in my previous employer was a Friday 5/15/2009 and my attorney entered 5/17/2009 (Sunday) as my last day on the LCA coz my first day in my current employer was 5/18/2009.
I am asking my former co-workers to write experience letter for me. Should I let them write '5/15/2009', or '5/17/2009' or just '5/2009' on the letters?

I�m currently on H1B, I'm planning to go back to my country for an extended period.
Few queries
1) Can my employer keep my H1B open and show that the job is available for me? If so, for how long can employer do that?
I may go for six months, year or more, depending on circumstances.
2) If after a year a new H1B is filled, by the same employer (given that old H1B cannot be opened for long) will I be able to utilize the old quota or would have to file in new quota.
3) If I come back after a year, does the 6 year counter restarted? ie. the limit of working for six years on H1B.
4) If my employer cancels my H1B, and after six-months or a year, a different company files a petition for H1B, will the petition fall in old quota? Or will have to wait to be filed in new quota for that financial year?
If someone could answer my queries and help me decide, it will be very helpful.

Hi All,
I have I-140 with PD of 2004 from previous company. From the current company I had started new GC process.
a) Previous labor title is software engineer. New labor title is Computer support specialist.
b) New perm process just started and job order has been posted last month.
In the job order company didnt give much details and only one sentence which is related to the old labor job description though it has 8 lines describing the job description
c)Should the above be a problem for porting the PD? Also current company has not done the sunday ads. Can they include all 8 lines describing the job description in the sunday ads?
d)I am in Viriginia and which sunday news papers do you recommend(EB2)
category.
e) Is there any PERM filing fee ?

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!
If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

One of my friend who is an accountant's H1 visa was sponsopred by a non-accounting firm who needed an accountant who is familiar with accounting pratices here is USA and India. Now that the firm who initially hired him and sponsored his visa doesn't have a full time accountant requirement and he is finding it difficult to find an accounting firm to sponsor his visa. But the firm who originally hired him is willing and has an opening to place him in an accounting firm as accountant. But since the firm who originally hired him is not an accounting firm is there any legal issue in doing so. If it is legal, what should the either of the firms and/or he should do as far as paperworks are concerned.

WASHINGTON (Reuters) - These are tough times for the Democratic-led U.S. Congress, where partisan battles have led to little progress on big issues and have made lawmakers collectively less popular than President George W. Bush.
Congress, typically never all that popular to begin with, starts the second half of 2007 with an anemic job approval rating of about 25 percent, down from 43 percent in January, with one Gallup poll ranking lawmakers at 14 percent.
Experts attribute the woeful rankings to an inability to force a change in direction in Iraq, the priority Democrats campaigned on to gain power in both the House of Representatives and the Senate in last November's elections.
But that is not all. There has been little to show on other priorities, including a change in Social Security and other entitlement programs that will run out of money in the years ahead, in addition to overhauling a health care system that has left millions uninsured and a broken immigration policy.
"I think Americans were expecting a great deal from the new Congress, and Congress has always been held in low esteem, but Congress really hasn't delivered on what it promised, especially on Iraq," said Paul Light, a congressional expert who is a professor at New York University.
Democrats in charge of Congress insist they have made progress on several issues, like increasing the minimum hourly wage and getting money for victims of the 2005 Katrina hurricane. They blame the Republican minority for a failure on others such as immigration, greater energy independence, and on negotiation of lower-priced drugs for Medicare.
"I'm not really much for polls," said Senate Majority Leader Harry Reid of Nevada. "We're going to continue doing what we think is the right thing for the American public in spite of a White House and the Republicans who are stalling every step of the way."
IRAQ DEBATE
Democrats drew a line in the sand over Iraq in the spring, using a $100 billion war spending bill to try to force Bush to accept a troop withdrawal date.
The effort failed miserably, with Bush finally getting what he wanted with no strings attached, and the White House saw the fractious debate as taking time away from work on other priorities.
"They've proven that they're not capable of taking on big issues," an administration official said.
Democrats beg to differ, pointing out that under their stewardship the Congress has resumed its traditional watchdog role over an administration they feel got off scot-free under Republican leadership.
"I would say in the first six months, gauging how things operate here from the majority, that we had some important work to do," said House Speaker Nancy Pelosi of California. "We had to drain the swamp. We had to create the oversight."
With American patience running thin over the Iraq war and casualties rising, Democrats may eventually force a change in direction in the unpopular war, an effort being renewed this week on Capitol Hill.
The Iraq situation has so infuriated the Democratic left that Cindy Sheehan, the California liberal who began a long protest against Bush after her soldier son Casey was killed in Iraq, is talking about running against Pelosi in 2008.
"I think the decline in support (for Congress) since the Democrats took over reflects in part the unhappiness of the base in the inability of Democrats to immediately stop the war in Iraq," said Thomas Mann, a congressional expert at the Brookings Institution.
The analysts say Congress' low poll numbers also reflect an altogether negative mood among Americans who are tired of the war, fed up with rising gasoline prices and worried about their jobs in a changing economy.
But how all this plays out in the 2008 election is hard to say. Incumbent lawmakers, while collectively held in low esteem, rarely fail to win re-election.

A friend of mine has submitted visa application fee and has made an appointment for visitor visa next week.
Can someone please tell if there is any other requirement of making a draft for some other fees during the Visa interview? (I am confused because a couple of years ago we used to submit one more bank draft during Visa interview)
