If i have labor and 140 approved with previous employer, can i go back to join them on H1B and continue GC process? Appreciate any advise. The new company is unable to start GC process due to economic conditions and capout date is Sept 2010.

I joined and contributed already to the IV although I am not yet on the GC queue. I support you all with my heart.
I have a different concern about PERM filing. My application will be EB2 with Ms + 4 years as Senior Soft Eng, and my lawyer asked my manager to create the business necessity letter for MS degree. He is not experienced with this kind of paperwork and the lawyer seems to be just not helpful rather demanding... I was wondering if somebody in IV had to deal with this business necessity letter. Any information would be helpful...

Hi,
My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

When to expect EAD /AP if I had filed my EAD/485/ on June 10

I know this one guy has done this he worked on h1 for 6 years after that he didnt get extension so he changed his status to f1 as full time student ...now he is on f1 visa...so dont worry.

I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

Hello everyone, thanks in advance for any reply.
I mailed in my wife's I485 and I130 together (she's from China, and we just got married a month ago), and I just realized that I forgot to include the marriage license with the forms!
Now, what are my options? I noticed that they have not cashed my 2 checks yet, should I cancel them so I at least don't get charged for the forms that will be rejected?
Or, is there any way for me to mail the marriage license separately and hope they get it?
Right now, I think it would be better to just redo the forms, but do I have to wait for the forms to get rejected first?

I know that most of the people on this forum are EB filers. However, for the few stragglers here who are filing in the family based category, please share your experience on filing the I-751 (petition to remove the condition on the GC). Specifically, I'd like to know the following:
- Estimated time from filing date to receipt of permanent GC
- Did you have interview with USCIS?
- Compare / contrast with first interview during the AOS process.

There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.
Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.

Your cover Letter is not a USCIS document. As long as the actual application forms and supporting documents are good you should have nothing to fear.
