    Hi all,

    Looks like our company is going to merge with another company in the next 2 weeks and the name is going to change ... I am not sure about Tax-id ....

    I filed 485 during the July 2007 rush and had I-140 approved in May 2007. I am currently on H1 expiring in Sep 08 .. I sent the papers to the lawyer for extension last week with the current company's documents ... not sure if they applied yet ...

    So my questions are:
    a) Do I need to do an I-140 Amendment for sure ... (or) can I use AC-21
    b) Any risks associated with I-140 Amendment? If something bad happens to the Amendment, Can I still use the priority date (Dec 2006) ...
    c) Should I file for H1B Amendment also

    FORGET ABOUT November's bipartisan promises of civility and cooperation in Congress. At the time they seemed overly optimistic. Nonetheless, it is hard to believe that relations could have deteriorated so far so fast -- both between the new Democratic majority and congressional Republicans and between Democratic lawmakers and President Bush.

    Thursday's late-night rumble on the House floor, when a vote was gaveled to what Democrats acknowledge was a premature close, epitomized the ugliness that has overtaken the entire legislative process. In the end, the 110th Congress headed for its August recess with civility in shreds and achievements sparse. Indeed, the only thing that might make August look pleasant is September, when lawmakers will return to resume the acrimonious debate over Iraq policy and confront the looming end of the fiscal year with spending bills unpassed and presidential vetoes in the offing.

    There have been scraps of good news from the first seven months. Lawmakers managed to see two of their priorities become law: an increase in the minimum wage and passage of the recommendations of the Sept. 11 commission. Another major achievement, a lobbying and ethics reform bill that will make important changes in the way Washington does business, is awaiting Mr. Bush's signature. Both chambers passed versions of a measure to extend the health insurance program for children in low-income families.

    But many other Democratic priorities -- and a big presidential one, immigration reform -- were snarled in the Senate. The 60-vote majority needed to overcome a filibuster proved to be as big an impediment for majority Democrats as the Democrats had made it when Republicans held power. The failure of immigration reform, of which there had been at least a hope of bipartisan achievement, was a particularly low note. Meanwhile, Democrats in both chambers chose to spend countless hours mired in a fruitless effort to compel an "end" to the war in Iraq.

    One of the most disappointing recent developments has been the administration's apparent decision, in the aftermath of the immigration bill's failure, that there was not much to be gained from working with this Congress -- and something to gained by taking it on. This new belligerence has manifested itself in a blizzard of veto threats -- Democrats counted up 31 between May 1 and Aug. 1 -- the most regrettable of which involves the children's health insurance bill.

    In the final hours before recess, it was hard to know which was more shameful: the administration's use of the looming vacation to bully Democrats into accepting its overbroad rewrite of the Foreign Intelligence Surveillance Act or Democrats' spinelessness in caving to this strong-arming.

    On the House side, a major disappointment was the failure of Democrats to live up to their pledge to treat the new Republican minority better than Democrats were treated when Republicans held power. Democrats promised a new, more open House, with adequate time for members to digest complex legislation and ample opportunity for the minority to offer amendments on the floor; instead, they, too, often used the same hardball tactics to muscle through legislation that Republicans had employed. That might have been understandable in the Democrats' "first 100 hours" that the new Congress was in session, but it is unfortunate that it persisted until the recess. That's no way to do business, and Democrats know it.

    Hi,

    I want to go outside of US and return back on December 8, 2010 while my passport expires on June 6, 2011. I will be entering on an advance parole document obtained as an I-485 applicant. As such at point of entry my passport will be expiring in less than 6 months (5 months 28 days). Please let me know if the passport needs to be valid for 6 months at the time of entry or this restriction does not apply to entry based on parole.

    i got married with my husband right before he filed his i-485, so we can file it together. His i-485 recently got approved, mine is still pending since March 2007. After speaking with IO, I found out that my name check is pending. My name is not common, I had no interaction with a law agencies in any way. So, I suspect that name check is just an excuse.
    My question is, can my marriage to my husband just before i-485 filing be a reason I am still waiting? Has anybody experienced something like this? I'm not from a country where arranged marriages are common practice and we have a child together.

    Please help me with online address change for CA DMV:

    My current license expires in May 2010. I moved recently. If I change my address using CA-DMV�s online change of address process, Will I be able to renew my driver license online during renewal time (feb 2010)?

    Whats the process for updating the address of the vehicle so that vehicle registration renewal (expected in Jan 2010) comes to the new address?

    With my HTC Mozart, I can download app called 'Stocks' which basically look after stocks (nasdaq etc...).

    The charts/graph looks very nice and I wonder how they do that ?

    I've applied for I 140 at TSC and my reciept date is Dec. 15, 2007 Under EB1,

    Can i apply for I 485 while my I 140 is pending or should i wait for the approval first.

    I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.
    Are you serious? Wait until your date become current and until then do not do anything. Instead of looking for ways to withdraw your I-485, why dont you look for ways to find a job that matches your I-140 skills, so that you can use AC21 portability.
    You will never know when will you get your chance to file 485 again if you withdrew it.

    WASHINGTON �Senator Mitch McConnell of Kentucky, the Republican leader, operates with near-robotic efficiency when it comes to negotiating budget figures in public, consistently refusing to answer questions that would ever commit him to a specific number at the bargaining table.

    So it was more than a little telling when Mr. McConnell laid down his mark in the current budget fight on Tuesday, informing the Capitol Hill press corps that he was ready to offer Democrats a deal, $70 billion in war financing with no strings attached and a total budget identical to President Bush�s proposal.

    In other words, the Republicans should get virtually everything they want. And he was not kidding.

    With the president warning repeatedly that he will veto any budget package he dislikes and the Democrats short of the 60 votes they need in the Senate, the Republican minority is in an unusually strong bargaining position � and not just in the budget negotiations that are the top priority in Congress these days.

    Mr. McConnell and his fellow Republicans are playing such tight defense, blocking nearly every bill proposed by the slim Democratic majority that they are increasingly able to dictate what they want, much to the dismay of the majority leader, Senator Harry Reid of Nevada, and frustrated Democrats in the House.

    In fact, the Senate Republicans are so accustomed to blocking measures that when the Democrats finally agreed last week to their demands on a bill to repair the alternative minimum tax, the Republicans still objected, briefly blocking the version of the bill that they wanted before scrambling to approve it later.

    For the Democrats, it was a perfect example of why they have taken to calling the G.O.P. the �grand obstructionist party.� The Democrats send out daily tallies of the number of Republican filibusters, which the Democrats say will set a record.

    It also explains why so little is getting done in Congress right now. With a crush of legislation pending ahead of the Christmas holiday recess, it should be one of the busiest times of the year.

    In addition to holding up a spending deal and setting the terms on the alternative minimum tax, Senate Republicans blocked a major energy bill on Friday. Mr. Reid said Tuesday that he planned to remove a major component that the Republicans opposed in hopes of getting the bill approved.

    The Republicans are not shy about their strategy, which they say is merely exercising the minority�s right to filibuster, which has existed since the earliest days of the Senate. Nor are they shy about standing with Mr. Bush, who now threatens almost daily to use his veto to back up the strategy.

    But there are also risks. The latest New York Times/CBS News poll found that the stagnation in Congress has made an impression. Just 21 percent of Americans say they have a favorable view of Congress and 64 percent disapprove. And the two parties have been unyielding, calculating that voters will blame the other side.

    For some lawmakers, especially those facing re-election, the danger is palpable.

    �I am not seeing much common ground, meeting in the center,� said Senator Gordon H. Smith of Oregon, a Republican who is seeking a third term. �And if we don�t find that, the Senate will fail in its governing responsibilities.

    �The thing that�s important to remember is that the Senate was structured to govern from the center, to find the common sense. There is little sense about this place right now.�

    Democrats say the Republican stance, especially on spending, is reckless and aimed at shutting down the government.

    Senator Charles E. Schumer of New York, who leads the Democratic Senatorial Campaign Committee, insists that the more Republicans block Democrats in Congress, the more seats Democrats will win next year.

    Republicans have to defend 23 Senate seats next year, nearly twice as many as Democrats, who have 12 to defend.

    The Republicans, however, say their strategy will win.

    �I think we are being consistent here against higher taxes, consistently against greater regulation, consistently against creating new causes of action in bill after bill after bill,� Mr. McConnell said. �It�s a positive message of our vision of America.

    �We have a pretty good sense that the public has figured out they are not too happy with this new Congress.�

    By the calculation of Mr. McConnell and other Republicans, voters will reward them for stopping the Democrats from doing all sorts of things that the Republicans view as foolish.

    Aides to the Republican leadership said they hoped to supplement that message with an agenda that they plan to lay out early next year and that they said would show clear differences with the Democrats.

    In the meantime, Mr. McConnell and the Republicans, with Mr. Bush�s support, effectively have a stranglehold on the Senate. That has in turn created bitterness between Democrats in the Senate and House, where Democrats have a larger majority and more leverage.

    Mr. Reid met Tuesday afternoon with Speaker Nancy Pelosi of California as the Democrats continued to struggle to formulate an �omnibus� spending package that would bundle 11 appropriations bills and avoid a shutdown of government agencies.

    Democrats last week pushed to add $11 billion for domestic spending, above what Mr. Bush had proposed, in exchange for money for the war effort, with no strings attached. But Republicans objected, and Mr. Bush threatened a veto.

    Democrats then suggested cutting home-state projects, typically called earmarks, sought by lawmakers in both parties, but on Tuesday Mr. Reid seemed to back away from that idea.

    Mr. McConnell, of course, said it was up to the Democrats to work things out, whether on spending or any other measure, in a way that Republicans would accept.

    �They are in the majority,� he said. �But in the Senate, to do most things, it requires 60. That has been the case for a long time, and it will require working out our differences. So we�re prepared to work with them to finish up the session. But the bills will not be written exclusively by Democrats.�

    Hello All,

    The officer at the SSN issuing center told me since my passport and the stamped I-94 have my maiden I will get an SSN also in the maiden name and not my married name.

    However I had already filed for my EAD (form I-765) before getting this information with my married name which I need to change to the maiden name. I have received an appointment letter for biometrics/finger printing (FP) . What should be done now? Should I wait and tell the officer during the FP about this name change that I need or how should I go about it?

    Pending - i824 in Sept 2007 to convert AOS to CP (hoping it will get through by Oct this year)

    Question:
    Assuming we get CP interview before AOS gets adjudicated, are there any potential issues in this scenario?

    Or has anyone come across any case like this... or is in the same boat?

    Hello,
    I am in a pretty scary scenario...

    My I-140 got denied based on inability to pay. My firm did send out the appeal to fight out the case. The appeal was sent 15 days back with the time limit stated in the denial letter. But today, I received the I-485 denial for both me (primary applicant) & my spouse (dependent).

    I have H-1 as a back up but my spouse does not have H-4 status.

    My Questions & concerned:

    1) How long does it take INS to accept the appeal as I haven't seen any update on the same since the package has been delivered (15 days)?

    2) What is next possible step for my spouse & how long can he stay in this country without applying for H-4?

    3) If the appeal is accepted & the case gets into processing, will I-485 get back on track for processing & can my spouse start working on EAD?


    Would appreciate any sought of guidance possible from the expert lawyers & the individuals with the similar experience & knowledge.

    Time is very crucial & so immediate reply will be highly appreciated...
